General Terms and Conditions

Precedence

Our sales are governed by these terms and conditions, which prevail over any purchasing conditions, unless expressly agreed otherwise in writing.

Retention of Title

The goods sold remain the property of Opti Aménagement until full payment of the invoiced amount has been received. However, the risks are transferred to the buyer as soon as the goods leave the seller’s premises or warehouse.
In the event of non-payment within the agreed timeframe, the seller reserves the right to reclaim the delivered goods and, if deemed appropriate, terminate the contract.

Order Cancellations

No total or partial cancellation of an order will be accepted without our prior written agreement.

Delivery / Order Fulfillment Times

Orders are fulfilled subject to stock availability. Delivery times are generally between 2 and 3 weeks.
Delivery delays may only be invoked by the buyer to refuse goods if they are significantly exceeded.
We shall not be held liable for delays or failure to execute orders, in whole or in part, in particular in the following cases:

  • If the payment terms specified in our order confirmation have not been respected by the buyer;
  • If the necessary information for processing the order has not been provided in due time;
  • In the event of force majeure, including strikes, accidents, fire, natural disasters, supply shortages, delays from suppliers or carriers, or any cause beyond our control.

Delivery

This service provides home delivery without assembly or unpacking of the products. Delivery is made by a carrier to the nearest accessible location at the indicated address. It includes unloading but not delivery upstairs.

Claims in Case of Damage or Missing Goods

Our goods are delivered cleared of customs. They travel at the recipient’s risk.
It is the recipient’s responsibility to make any necessary reservations with the carrier before accepting delivery. These must be noted on the delivery slip, a copy of which must be kept by the customer.
Reservations must be confirmed within 48 hours by registered letter to the carrier.

Payment

  • Payment must be made in full at the time of order;
  • Our invoices are payable at our registered office, regardless of any clauses stated on purchase orders;
  • In the event of failure to pay any installment, all outstanding amounts become immediately due;
  • Product malfunction or repairs cannot justify non-payment or delayed payment.

Late Payment

In the event of late or non-payment, Opti Aménagement reserves the right to suspend all current orders.
In accordance with Article 441-6 of the French Commercial Code, any unpaid amount will automatically incur late payment interest at the legal rate applicable on the invoice date, increased by four points, from the due date until full payment.

Insolvency / Bankruptcy

If the buyer ceases payments, or is subject to bankruptcy or legal proceedings, before or after delivery of unpaid goods, the sale will be automatically terminated unless we decide to maintain it.

Warranty

Our products are guaranteed for 2 years under normal use. The warranty does not cover damage resulting from improper use.

Complaints

All complaints must be submitted in writing (registered letter) in detail as soon as possible after receipt of the goods to the following address:

Specifications and Dimensions

Opti Aménagement reserves the right to modify its products at any time without obligation to update previously delivered or ordered products.
Models shown in catalogs or brochures may also be modified without prior notice. Such changes do not engage our liability and will be communicated where applicable at the time of order.

Returns

No goods may be returned without our prior consent and instructions.
Standard products must be returned in their original packaging and in good condition.
Upon acceptance, a refund of 90% of the invoiced value will be issued.
The right of withdrawal applies only to standard products.
For distance sales to non-professionals, a 14-day return period applies from delivery.
Return shipping costs are borne by the buyer, except in the case of defective or non-compliant goods.

Data Protection

In accordance with French Data Protection Law No. 78-17 of January 6, 1978, you have the right to access, modify, or delete your personal data by contacting our headquarters.
Only our company receives the information you provide.

Applicable Law / Jurisdiction

French law shall apply exclusively.
All disputes will be brought before the Commercial Court of Paris if the buyer is a business. Otherwise, jurisdiction will be determined according to applicable civil procedure rules.

Shipping and Delivery

Delivery Times

Orders are processed subject to stock availability. Delivery time is generally 2 to 3 weeks.
We are not liable for delays under the conditions listed above (force majeure, payment issues, etc.).

Delivery Terms

Delivery is made without unpacking or installation, to the nearest accessible location. Unloading is included.

International Delivery

We provide quotes for international shipping (road, air, or sea).


Order Reception

Please check that the number and description of packages match the delivery note.
Inspect the goods upon receipt.
In case of damage or discrepancy, clearly note it on the delivery slip before signing and confirm by registered letter within 48 hours.
No claims will be accepted if these procedures are not followed.
